To combat this, they believe an overall approach is best.<\/p>\n<p>&#8220;We have a situation where some local authorities will ban nudity and others will not,&#8221; says Kent University Professor Phil Hubbard. &#8220;The whole situation has led to a whole range of appeal cases and litigation in which legal unreasonableness and inconsistency have been raised as valid concerns, and some of these appeals have been upheld.&#8221;<\/p>\n<p>&#8220;It has created a great deal of anxiety, expenditure and time for local authorities who have been left to evolve policies of their own.&#8221; <strong>Of course, the main concern seems that be stopping the owners of massage parlours from &#8220;effectively [licensing] their premises as brothels.&#8221;<\/strong><\/p>\n<p>In short? They don&#8217;t want a slip in local council policies to allow things like brothels and other unsavoury places to pop up. Nope, sex and sexual arousal in Scotland will not be tolerated, it seems. Is this just the first step on a very steep slope?<\/p>\n<h2 class=\"inline\">Unnecessarily broad<\/h2>\n<p><strong>In theory it might sound great &#8211; one big policy means councils don&#8217;t have to worry about getting theirs wrong or ending up in court because of a miswording.<\/strong> It can save a great deal of money and let the councils focus on other matters. They fear that this &#8220;draconian regime&#8221; might cause more problems in the future.<\/strong><\/p>\n<p>The licensing specialist at the Association of Licensed Adult Entertainment Venues Scotland also spoke out, stating that &#8220;it would be very unwise to try to fetter the decision making of the licensing boards, licensing committee or planning committees. We have to allow for local decision making whether it is for sexual entertainment venues, alcohol licensing or any other form of licensing.&#8221;<\/p>\n<p>What might the policy mean for the industry? <strong>Well, it means that different venues around Scotland will all work under the same policy, meaning fairness across the land. Yet what this &#8220;fairness&#8221; entails has yet to be seen.<\/strong><\/p>\n<p>Is it a good idea?
